Official Contest Rules

Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the sponsor and judges, which shall be final and binding on all contest-related matters.

1) Contest Timing:
The Exergen “Spot The Scanner” Contest begins 9:00 p.m. ET on 12/2/2010 and ends approximately May 2011 (season 7’s end).

2) Eligibility:
The contest is open only to legal residents of the 50 United States and the District of Columbia, who, as of date of entry, are 18 or older. Employees and immediate family members of the Exergen Corporation are not eligible to participate. The term “immediate family” includes spouses, grandparents, parents, siblings, children and grandchildren of the contestant. Void where prohibited by law. All federal, state, and local laws and regulations apply.

3) How to Enter the Contest:
There is No Purchase Necessary to participate in the contest. During the contest period, you may access the contest by visiting www.exergen.com/spotthescanner and via the contest link on the Exergen Fan Page. The Exergen TemporalScanner is not guaranteed to appear in every episode of Grey’s Anatomy. In the event that it does appear, the first 5 (five) people to email spotthescanner@exergen.com with the name of the person who was holding the scanner (specific doctor), the time you saw the scanner as well as full name and mailing address of entrant will win 1 (one) Exergen TemporalScanner home model. Limit of 1 entrant per email sent/received and one prize per household.

• The entry must not contain content that is known by you to be false, inaccurate or misleading
• Any entry deemed inappropriate or unsuitable, at sponsor’s sole discretion, will be disqualified. Entry must not contain material that is inappropriate, indecent (including but not limited to nudity, or pornography), profane, obscene, hateful, defamatory, slanderous or libelous.

*The contest is only applicable to new episodes of Grey’s Anatomy. For every new episode that does not feature the TemporalScanner, 5 subsequent prizes will be added to the next new airing. Bonus prizes will carry over until a new episode airs featuring the TemporalScanner thermometer. Once a new episode featuring the TemporalScanner runs, prizes will be re-set to 5 once again.

By entering this contest you give Exergen Corporation the authorization to use your name, photo, or likeness in promotional materials without further compensation.

4) Judging:
The decisions of the judges of this contest are final. Contest entries are applicable to the show’s original ET airing (not valid in relation to re-runs and syndication). Judges will select winners based on the first *5 (five) entrants to successfully spot the Exergen TemporalScanner and fill out the required information correctly via email.

* Note that the number of eligible entrants may go up if a new episode(s) of Grey’s Anatomy without the TemporalScanner has aired.

5) Winner Notification:
Each winner will be notified by phone or email within 24 hours from date of winner’s determination.

6) Prizes and Approximate Retail Values: One (1) Exergen TemporalScanner (home model)
Winners will receive a home model of the Exergen TemporalScanner thermometer (ARV of prize is $49.99 USD plus standard shipping). No transfer, substitution or cash equivalent for any prize will be permitted, except at the sole discretion of the sponsor. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize.

7) General Rules:
By participating in the contest, entrants agree to be bound by the official rules and the decisions of the sponsor. Judges’ decisions are final on all matters relating to the contest. The Exergen Corporation (“the Sponsor”) is not responsible for undeliverable, lost, delayed, misdirected or misaddressed email or any other issues regarding the electronic delivery of the entry. This includes, but is not limited to, the speed at which your email service routes email through the internet. The sole determiner of eligibility for the prize will be the time the email is received by Exergen. Failure to comply with any published contest rules is grounds for immediate disqualification from the contest. The sponsor and its agencies will have no liability or responsibility for any claim arising in connection with participation in the contest or the awarding of prizes. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in the contest or use or redemption of prize.

8) Sponsor:
The sponsor of the contest is the Exergen Corporation, 400 Pleasant Street, Watertown, MA 02472.

The contest is in no way sponsored, endorsed or administered by, or associated with Grey’s Anatomy, ABC or Facebook. You understand that you are providing your information to the Exergen Corporation and not to Facebook. The information you provide will only be used in the event you are selected as a contest winner.
