| EXERGEN WINS JURY VERDICT OF PATENT INFRINGEMENT |

Exergen Corporation, a Watertown, MA based company that is the world's leading innovator and manufacturer of non-invasive infrared detection devices for industry and medicine, won a patent infringement suit in the U.S. District Court of Boston against SAAT, Ltd., Daiwa Products, Inc., and CVS, Inc. for infringement of three of Exergen's patents on its unique and highly successfully temporal artery thermometer. The jury rejected the defendants' invalidity claims and awarded Exergen lost profit damages.
Exergen received the Small Business Association of New England Award in 2002 for its Temporal Artery Thermometer - the product that is the subject of the lawsuit, which is manufactured in the USA at its plant in Watertown MA. A fast, accurate, non-invasive method of taking temperatures by gently scanning the forehead, Exergen's temporal artery thermometer has been clinically proven more accurate than ear thermometry, and accuracy comparable to highly invasive devices such as rectal, pulmonary artery and esophageal thermometers.
Developed by a team led by Dr. Francesco Pompei, who also holds an appointment in the Department of Physics at Harvard University, Exergen's temporal artery thermometers are protected by 20 US and foreign patents. Exergen holds more than 50 issued patents naming Exergen's founder and president, Dr. Pompei, as inventor. |
