Exergen Steps Up Defense of Its Patents on Temporal Artery Thermometry

Boston, MA, July 25, 2003- Exergen's Temporal Artery Thermometers, having received world-wide acclaim for fast, accurate, and truly non-invasive temperature, have attracted extensive attention from many who may be unaware of the extent of Exergen's patent portfolio directed to forehead thermometers. Exergen owns 11 United States patents protecting its TAT-2000C consumer model (Nos. 6,292,685; 4,636,091; 5,012,813; 5,199,436; 5,653,238; 5,874,736; 6,045,257; 6,047,205; 6,056,435; 6,299,347; 6,319,206) and an additional 8 US Patents protecting its professional models. Exergen also owns international counterparts to the US patents and additional US and foreign patents are pending. The patents covering the products are printed on every Exergen thermometer.

Exergen concluded a patent infringement suit in 2001 against Safety 1st, Inc. for a forehead thermometer with an amicable settlement when Safety 1st agreed to stop activities with the thermometer, which was manufactured by SAAT, Ltd. of Israel (link to release). In an ongoing suit in US District Court in Boston against SAAT, Daiwa Products, Inc. of Florida, Hana Microelectronics of China, and others, for the same product offered by Safety 1st, Exergen is vigorously defending its patent rights in asserting five patents against the SAAT product.
