| EXERGEN WINS PATENT INFRINGEMENT SUIT ON TEMPORAL ARTERY THERMOMETRY |

| Boston, MA, July 1, 2001- In a recently concluded lawsuit in US District Court in Boston against Safety 1st, Inc of Canton, Massachusetts, a subsidiary of Dorel Industries, Exergen Corporation alleged that Safety 1st infringed four US patents owned by Exergen, by "making, using, offering to sell, selling and/or importing" the Hospital's Choice Forehead Thermometer. To settle the suit, Safety 1st agreed to stop its activities in making, importing or selling this product, to direct retailers interested in this product to Exergen, and to identify the source of the accused product, developed by SAAT, Ltd of Israel. |
| Exergen Corporation is the developer and manufacturer of the TemporalScanner Infrared Temporal Artery Thermometry System, which is currently being introduced to the professional medical community, and will be available for consumers later this year. Proven to be more accurate than ear thermometry by Harvard Medical School physician-scientists, the TemporalScanner is protected by more than 15 US and foreign patents. |
