Exergen Corporation Wins Patent Infringement Trials
September, 1997.  In a recently concluded trial, the U.S. District Court for the District of Massachusetts found that Gentri Controls, Inc. and its president, Raymond C. Paulk were in willful contempt of the Court’s May 2, 1995 Order permanently enjoining Gentri and Mr. Paulk from making, using, or selling certain infrared instrument products.  The Court further ordered that Gentri and Mr. Paulk pay additional damages and attorney’s fees relating to the contempt.

In the earlier jury trial, the Court found that Gentri Controls, Inc. and its president, Raymond C. Paulk had willfully infringed two U.S. Patents owned by Exergen Corporation, and had misappropriated trade secrets of Exergen in connection with certain products manufactured and marketed by Gentri.  The Court had permanently enjoined Gentri and Mr. Paulk from making, using, or selling its Thermal E, Thermal ELS, and ATC-600 Series infrared instrument products, and also ruled that the patent infringement damages awarded by the jury were to be trebled, and awarded Exergen costs and attorney fees.
